by 共力研究社 (TPEC)This article analyzes Wanhua Chemical (formerly Asia Chemical) as a case study of the structural limits of Taiwan’s unfair labor practice system. Since its incorporation into a larger corporate group in 2013, the company has faced repeated labor disputes involving union leaders and, more recently, migrant workers seeking union membership. Although labor authorities have issued formal rulings, these interventions have often failed to prevent continued pressure on union activity. The article highlights how legal remedies tend to operate after harm has occurred and how labor brokers, while not legally defined as employers, wield substantial influence over migrant workers. It argues that without stronger preventive mechanisms, unfair labor practices risk becoming a manageable cost rather than an effective deterrent.

在戰爭與總體戰下,勞工不會消失,只是被迫在新的規則下持續工作。本文比較義大利、法國、英國與美國的戰時勞動體制,梳理高壓軍事化管理與「統合協商」兩種路線的差異,說明戰時勞動政策如何影響戰後民主與社會穩定。最後回到台灣,提出《全動法》與國防體系中缺位的「勞動視角」,主張現在就應設計兼顧動員效率與勞工權益的戰時勞動體制。

《經濟學人》指台灣長期壓低匯率,導致「台灣病」、薪資停滯與房價高漲。本文檢視匯率、物價與實質薪資數據,指出弱勢匯率與低薪之間難以畫上直接等號,真正關鍵在於勞動分配率下降與勞資權力失衡,主張應把焦點從匯率之爭轉回分配結構與勞工議價能力。

我們認為現行政策恐導致雇主以微幅加薪換取更多廉價勞動力而削弱本勞需求。若要兼顧缺工與勞動市場穩定,應課以足以弭平薪資差距的高額或階梯式規費,讓企業在聘僱移工時承擔合理成本。同時,政策應從根本上提升移工薪資與權益,將其視為與本勞平等的勞動者,而非低價替代品,方能真正回應人口減少與產業升級的挑戰。

企業是現代資本主義的核心制度。企業整合資源、資本與勞動,提供社會所需的產品與服務,勞工獲取工資後進行消費,從而形成經濟循環。即便在戰爭期間,大量人力物力納入政府掌控調配,各種綿密而細微的經濟活動仍需要透過企業組織協調。

上一篇文章已經粗略討論了「民防」,接下來的問題是,民防面對的是災害搶救、緊急應變,但當戰事延續,社會機能的維持,包括物資的生產、重要服務的提供,並不能僅靠民防。在這樣的情境下,我們有必要引入「必要工作」的概念。其核心概念就是維持原先的民間生產與雇用,也就是在急難期間部分勞工需要繼續上班,以維持社會運作機能。
